What is the terms and conditions document?

This is an agreement between you and Eihal mobile application. It contains all the terms and conditions you must follow and comply with when using our websites, platforms, or online applications. These terms apply to all visitors, users, and others who access or benefit from the service. By accessing or using the service, you agree to all the terms and conditions below, without exception. If you do not agree to all or part of the terms and conditions, you must exit and cease using the service.

These terms and conditions may be subject to amendment or change. We do not have to notify you of such changes, and you should review the terms and conditions periodically. Your continued use of the service constitutes full acceptance of the terms and conditions applicable during your use of the service.

Terms of use

You must be at least 18 years old and have full legal capacity to enter into contracts and transactions.
You must comply with all applicable laws and regulations in the Kingdom of Saudi Arabia.
Your use of the Eihal Services has never been suspended.
You must provide true and accurate information when registering or using our Services, and update it periodically.
You will not obstruct the proper operation of the Services or attempt to harm the Platform or Application.
You undertake not to take any action that may cause unreasonable or disproportionate pressure on the Platform or its infrastructure. You must not create more than one account on the Platform.

You undertake to keep your account passwords and all means of identification we provide to you secure and confidential.
You are solely responsible for any losses or damages that may arise as a result of providing incorrect or insufficient information.

You must not send any messages that are threatening, immoral, racist, or in violation of local laws and international agreements. Any correspondence, addresses, or pseudonyms must not violate regulations, public morals, or good conduct.
You must not publish or upload any material that violates the laws and regulations of the Kingdom of Saudi Arabia, such as defamatory, offensive, threatening, racist, or morally inappropriate material, files containing viruses, or other content of any kind, regardless of its harmfulness.
You must not harass or threaten other users, any customer service staff of the Eihal App and Platform, or any medical practitioners on the Platform or App.
Your consent to the exchange of information between companies and regulatory bodies cooperating with Eihal regarding your transactions and evaluation of interactions with you.
Your commitment not to modify, extract, translate, summarize, create a derivative work based on decompiling, or reverse engineering the design of the Eihal Platform or Application, or otherwise identify, attempt to identify, or attempt to access the source code, internal design of the Services, or any text, multimedia images (photos, audio, video files), data, or other information provided by Eihal or third-party service providers.
Your commitment not to take any action that could harm or conflict with the intellectual property rights of the Platform.
Eihal Platform and Application have the right to refuse to provide service or prevent you from using the Service without giving reasons.
Eihal is designed to support your health decisions and the choices you make. We can only help you find good health information, whenever available and appropriate. Eihal is a technological facilitator and cannot be considered an application for providing medical or healthcare services, or a substitute for health insurance, a treating physician, or visits to your personal physician
You agree not to use the website or application for any commercial or advertising activities not authorized by the owner company, or to extract the contents of the website or application for commercial or advertising purposes.
Other than the personal information covered by Eihal platform and application privacy policy, any material you post or submit on the platform or application will be considered non-confidential and non-proprietary, and the owner company will have no obligations regarding such material.

Intellectual Property

All intellectual property rights in Eihal Platform and Application and all materials related to or appearing on it (including any content Eihal submits or posts and all content uploaded to the Site or App) are owned by the Eihal Platform and Application, which has the right to dispose of such property as it sees fit. You must not reproduce or permit anyone, for any reason, to use or reproduce the Services, or any trademarks or other trade names appearing on the Services.

Indemnification

By agreeing to these terms of service and using the service, you acknowledge and agree to indemnify the owner company and/or any of its affiliates, officers, directors, employees, users, attorneys, agents, affiliates, licensors, and entities and individuals directly contracting with it from and against claims, costs, damages, losses, liabilities, and expenses (including legal fees and costs) arising out of or related to any breach of these terms or applicable laws and regulations in the Kingdom of Saudi Arabia.

Contests and Promotions

Any contests or promotions (or similar offers) available on Eihal Platform and Application may be subject to terms and conditions that differ from these terms. When participating in contests or promotions, please take into account the applicable rules and our privacy policy. If the rules of a promotion conflict with these terms,the rules of the promotion will apply.

Cancellation and Refund

Eihal Platform and Application do not have the right to a refund after payment has been made. Refunds are requested through the doctor or center providing the service. Eihal Platform and Application are merely an intermediary for arranging appointments and referrals between the user and the service provider.

Availability of the Application and Website, Errors and Inaccuracies

- Due to disruptions or interruptions in electronic services, access to Eihal Platform and App is provided on an "as is" basis only.

- Offers and products on Eihal Platform and Application are constantly updated. Product descriptions or pricing may be incorrect or inaccurate, and we may experience delays in updating information on the Service or in our advertising on other platforms. We cannot guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Purchases/Payment

If you wish to pay for any product or service, you may be asked for certain information relevant to your payment transaction. The user represents and warrants that: (1) you have the legal right to use any credit card(s) or other payment method(s) in connection with any payment transaction; (2) the information you provide is accurate and complete. By submitting this information, you grant us the right to provide the information to a third party to facilitate the completion of the payment process. We reserve the right to refuse or cancel your order at any time for specific reasons, including but not limited to: product or service availability, errors in the description or price of the product or service, an error in your order, or other reasons.

Liability of Eihal Platform and App

- While adhering to the responsibilities stipulated by law and which cannot be excluded, the owner company and all of its affiliates, officers, directors, employees, users, lawyers, agents, affiliates, licensors, and entities and individuals directly contracting with it shall not be liable for any losses, damages, liabilities, claims, or costs (including, without limitation, legal costs, defence fees, or settlement costs) of any kind, whether directly or indirectly, resulting from your use of Eihal Platform and Application or as a result of or arising from your access to Eihal Platform and Application, or any content, third-party websites and applications, or third-party services, in any way arising, whether in contract, tort (including negligence), statutory, or otherwise.

- We are committed to diligently endeavouring to provide Eihal Platform and Application with all reasonable care. Except as required by law, we are not responsible for the quality, accuracy, or fitness for a particular purpose of Eihal Platform and App, and we do not promise that the material contained on the platform or website, or any of the functions contained in Eihal Platform and Application, or any of its servers will operate without interruption or delay, be error-free, free of viruses or bugs, or operate in a compatible manner with any other software or material.

- We are not responsible for any conduct or content of any third party available on the service. We are not responsible for any content obtained from the service.

Privacy Policy

This policy explains how Eihal app and platform collect, process, use, and protect personal data, in accordance with the provisions of the Personal Data Protection Law and its implementing regulations, as follows:

- Eihal app and platform collects personal data voluntarily provided by the user upon registration or while using the various services, such as: name, mobile number, email, and any additional data required by the service.

- Some technical data, such as Internet Protocol (IP) address, device type, and operating system, is also collected automatically for security and analytical purposes.

- Eihal application and platform uses this data to provide services, improve their quality, process requests and transactions, communicate with users, and study and analyse usage to enhance the user experience.

- The app and platform collect and process data based on legitimate grounds, including: explicit user consent, fulfilment of contractual obligations, compliance with laws and regulations, or achieving a legitimate interest that does not conflict with users' rights.

- Eihal app and platform are committed to applying the highest standards of technical and organizational protection to prevent unauthorized access, use, modification, destruction, or leakage of data.

- Personal data is not shared with any third party except in legal cases, such as explicit user consent, execution of an order issued by a competent authority, or with parties contracted with the platform, provided they adhere to data protection policies.

- In the event that data is transferred outside the Kingdom of Saudi Arabia, the application and platform are bound by regulatory controls, ensuring that the receiving party provides an equivalent level of protection and signing the necessary contractual guarantees.

- The user has several rights, including: accessing their personal data, requesting correction or destruction, objecting to its processing, withdrawing consent at any time, and filing a complaint with the competent authority in the event of a violation.

- The application and platform retain data only for the period necessary to achieve the purposes for which it was collected or as required by the regulations, and undertake to securely destroy it after the need for it is no longer there or the legal retention period expires.

- Eihal application and platform do not collect or process data from minors unless they have obtained the consent of their guardian, in accordance with the requirements of the relevant regulations. The application or platform may use cookies to enhance the user experience. Tracking options can be managed or disabled through your browser settings.

- Eihal application and platform reserve the right to update this policy periodically in response to any regulatory or operational changes, and will notify the user of any material update prior to implementation.

- Eihal application and platform affirm their commitment to implementing all legal provisions related to the protection of personal data. However, and without violating the law and regulations, the application or platform shall not be liable for any direct, indirect, or incidental damages resulting from unauthorized use, the user's negligence in maintaining the confidentiality of login information, or misuse of the services.

You further acknowledge and agree that the Eihal Platform and Application shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly urge you to read the terms and conditions and privacy policies of any third-party websites or services you visit.

Disclaimer of Liability

The application and platform operate solely to serve their users.
If the user suffers any damage resulting from negligence or negligence in performing the service, the user alone bears full responsibility, and the application and platform do not bear any obligations or responsibilities towards the user, as the relationship between users is confidential and is not privy to Eihal.
If a user is subjected to any harm from another user, such as insults, defamation, slander, hacking, or other harm, the application or platform shall not bear any obligations or responsibilities towards the user, as the relationship between the two parties is confidential and not disclosed to Eihal.

The user has the right to request that the other user provide them with certain data or documents to prepare and provide the service (when necessary). However, the user alone is responsible for providing these documents to the other user, and Eihal shall not be liable for any misuse of these data or documents by a user. Eihal shall also be committed to maintaining confidential documents and not disclosing the documents provided by the user.
Eihal shall, to the extent possible, keep the electronic content free from errors, technical defects, viruses, malware, and other hazards. In the event of a technical malfunction, cyber attack, or impersonation of the user's page, Eihal shall not be liable for any resulting consequences.
Eihal reserves the right to change or discontinue the services within the application or platform at any time, without prejudice to existing services, or to add new services.
Eihal reserves the right to permanently suspend or sell the application or platform at any time, without prejudice to existing services.
Eihal shall not be liable for any errors made by the user of the application or platform, whether the error involves a violation of the terms and conditions, or the exploitation of existing documents or those provided by users or service providers, or otherwise. Whether the error or violation was intentional or unintentional, the platform disclaims any liability for such errors.

Applicable law

These terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law provisions. Failure to enforce any right or provision of these terms shall not be deemed a waiver of those rights. If any provision of these terms is held invalid or unenforceable by a court, the remaining provisions of these terms shall remain in effect. These terms constitute the entire agreement between us regarding the Service provided by us, and supersede any prior agreements we may have had regarding the Service. Any disputes or claims regarding Eihal platform and application shall be subject to the laws applicable in the Kingdom of Saudi Arabia, and the city of jurisdiction shall be the city of Riyadh.
